• Training and support services
• Consulting services related to construction data management

The specific services provided will be detailed in individual service agreements or statements of work executed between infinitrixis and the client.

User Obligations

By using our Service, you agree to:

• Provide accurate, current, and complete information when creating an account or using our services
• Maintain the security of your account credentials and accept responsibility for all activities under your account
• Use the Service only for lawful purposes and in accordance with these Terms

infinitrixis Intellectual Property

• All software, dashboards, visualisations, and methodologies developed by infinitrixis remain our intellectual property
• Clients receive a licence to use deliverables for their intended business purposes
• infinitrixis retains the right to use general knowledge, skills, and experience gained during service delivery

Client Data and Content

• Clients retain ownership of their construction data and project information
• Clients grant infinitrixis a licence to use their data solely for service delivery purposes
• infinitrixis will not use client data for any purpose beyond the agreed scope of services

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

For construction data visualisation services, infinitrixis acts as a data processor for client data and implements appropriate technical and organisational measures to ensure data security and compliance with applicable data protection laws, including GDPR.

Service Availability and Performance

While we strive to provide reliable and continuous service, infinitrixis does not guarantee that:

• The Service will be available at all times or without interruption
• The Service will be error-free or completely secure

Payment Terms

For paid services, the following payment terms apply:

• Payment is due according to the terms specified in the relevant agreement
• Late payments may incur additional charges as permitted by law
• All fees are exclusive of applicable taxes unless otherwise stated
• Refunds are provided only as specified in individual service agreements

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall infinitrixis, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service
• Any unauthorised access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted via the Service

In no event shall infinitrixis's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to infinitrixis in the twelve (12) months preceding the claim, or €1,000, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless infinitrixis and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Service
• Your violation of any term of these Terms
• Your violation of any third party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Service caused damage to a third party

Governing Law

These Terms shall be interpreted and governed by the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.

The European Union's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr/. However, infinitrixis is not obliged to participate in alternative dispute resolution procedures.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

You may terminate your account at any time by contacting us at legal@infinitrixis.world.

Upon termination:

• Your right to use the Service will cease immediately
• Any outstanding fees remain due and payable
• We may delete your account and data in accordance with our data retention policies
• Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability

Force Majeure

infinitrixis shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, or any other cause beyond our reasonable control.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorised to use the Service.
